BOLINGBROOK, Ill. - The missing wife of a former police officer told a clergy member two months before she disappeared that she feared her husband, a church official said Thursday.
Stacy Peterson requested the late August meeting with a member of the Westbrook Christian Church pastoral staff when the church made a routine call to see why she and Drew Peterson had not attended services in recent months, Rob Daniels, the church's pastor of spiritual formation, told The Associated Press.

Excerpt: What I do recall from my guided tour of Drew and Stacy’s home (offered by Drew just hours after the police came through executing a search warrant) is two things - the top of a different blue container and the bed linens taken by police.
As I took the tour Drew offered me room to room exclusively and without any cameras, in the basement there was a large blue top to a container - not a barrel - but a rubbermaid type container that was very large without the matching bottom. Relevant? I don’t know. But it seemed odd to me that it was sitting there without the bottom in sight. Drew did not make reference to it.
Second, in Stacy and Drew’s bedroom, Drew did ask me to note that all their bed linens had been taken by police during their search. I checked other rooms and only the sheets in that room were taken as potential evidence. Relevant? I think so. Again, I don’t have news to share that the sheets or that container will connect Drew to any crime, but we have heard so much about the barrel I thought those of you following the case should know about the sheets.

The latest warrant dealt with items inside two vehicles already seized from Drew Peterson's home, said Charles Pelkie, a spokesman for the Will County state's attorney's office. He declined to elaborate.
Peterson's attorney, Joel Brodsky, told WFLD-TV that the warrant says police are seeking items that "may have been utilized in commission of the offense of first-degree murder or the concealment of a homicidal death."
The warrant also indicates interest in trace elements of several materials, including blue plastic, Brodsky told the Fox affiliate.
Brodsky did not immediately return messages from The Associated Press.
A relative of Peterson's reportedly helped him move a heavy container out of his home and put it the family's sport-utility vehicle the day his wife vanished, an allegation Brodsky denied last week. A nonprofit group helping to search for Stacy Peterson has said police asked them to look for a blue plastic barrel large enough to hide a body.
Illinois State Police did not immediately return a message left after business hours Tuesday.
After 23-year-old Stacy Peterson, the officer's fourth wife, disappeared in late October, authorities named her 53-year-old husband a suspect in what they have said is a potential homicide.
Prosecutors also are reviewing the death of Peterson's third wife, Kathleen Savio, and have said the drowning, deemed accidental at the time, may have been a homicide staged to look that way.
Peterson has not been named a suspect in her death.
"With all the hoopla, it's hard to believe something won't happen," he told WFLD-TV on Tuesday night.
On Nov. 1, state police seized two vehicles at the home the Petersons shared with their children — a GMC Denali and a Pontiac Grand Prix.
The vehicles were loaded onto trucks and taken to an undisclosed location.

Clearing the way for a possible wrongful-death lawsuit against Drew Peterson, a Will County judge Thursday reopened the estate of Peterson's deceased third wife, Kathleen Savio -- a legal move sought by her relatives.
"From our point of view, it's very positive,'' said Lawrence Varsek, one of the attorneys representing Savio's relatives.
But Varsek said the relatives are still exploring their options and won't move immediately to file a civil suit seeking to tie Peterson to his former wife's 2004 bathtub drowning.

Drew Peterson's attorney claims the cops have known all along that his missing wife planned to split while her husband was sleeping and that a classmate advised her to spend only cash to keep from getting found.
Attorney Joel Brodsky said he learned of the supposed scheme when prosecutors turned over documents related to a felony weapons charge filed against Peterson in May.
Among the papers was a complaint for a warrant to search Peterson's home following the disappearance of his fourth wife, Stacy Peterson, in October. The complaint contains a paragraph paraphrasing a statement from one of Stacy's classmates at Joliet Junior College.
According to the document, "Stacy had complained to (the student) over drinks after class on Oct. 27, 2007, at 4:30 p.m. that she wanted out of her marriage. (The student) suggested to her at that time that she should take the cash money and not use her credit cards to preclude being found. She responded that if she was to leave, she would leave in the morning when Drew was asleep."
Stacy vanished Oct. 28, the day after the supposed conversation. State police have named Peterson a suspect in her disappearance and labeled the case a "potential homicide."
State police also are probing the March 2004 death of Peterson's third wife, Kathleen Savio. State police found nothing suspicious about Savio's death during their first crack at it, but are revisiting the case in the wake of Stacy's disappearance.
Some disclosures
Brodsky redacted the name of the student Stacy supposedly spoke to.
"I can't tell you who it is until I've had a chance to talk to him," Brodsky said.
Charles B. Pelkie, the spokesman for Will County State's Attorney James Glasgow, confirmed Brodsky received documents as discovery in the gun case Wednesday.
He said he was not aware whether the conversation released by Brodsky was in the material and questioned whether it was appropriate for the attorney to have gone public.
"If Mr. Brodsky wants to disclose everything in discovery, that's his problem," Pelkie said.
Brodsky said he wished the conversation had been released by authorities earlier and called for "equal-opportunity leaking."
"All the bad stuff was leaked," Brodsky said. "They could have leaked this good thing."

Drew Peterson's attorney was smacked with a heavy revelation during a Thursday hearing for the embattled ex-cop's felony gun case.
Attorney Joel Brodsky called into question whether the state actually possessed recordings of overhears performed on his client, and learned from Judge Richard Schoenstedt that not only do they exist, but they are "extensive."
"Mr. Brodsky, you need to know that all these tapes, CDs DVDs, I have them," Schoenstedt said.
The judge explained he must review the recordings to see which are relevant to the gun case facing Peterson without jeopardizing any other ongoing police investigations.
State police are looking into the Oct. 28 disappearance of Peterson's fourth wife, Stacy Peterson. They have called the case a "potential homicide" and named Peterson their sole suspect.
State police also are investigating the March 2004 apparent bathtub drowning of Peterson's third wife, Kathleen Savio. They first found nothing suspicious about Savio's death, but are getting another crack at it following the disappearance of Stacy.
Two former friends of Peterson, Len Wawczak and Paula Stark, came forward in July to say they wore wires at the behest of the state police and recorded Peterson making incriminating statements about his involvement in one wife's disappearance and the other's death.
Following the hearing, Brodsky conceded he was surprised by Schoenstedt's revelation but insisted he was not concerned.
Peterson faces no criminal charges in connection with the fate of either wife, but was arrested in May for allegedly possessing an assault weapon with a barrel shorter than the state-mandated length. Peterson's attorney, Joel Brodsky contended Peterson carried the weapon as part of his duties with the Bolingbrook Police Department's SWAT team, and had permission to possess it.

Gag order
During the same Thursday hearing on the gun charge, Brodsky succeeded in thwarting prosecutors' efforts to shut him up.
Assistant State's Attorney Greg DeBord moved to impose a gag order on those involved in the case to prevent them from speaking to the media.
"This case is a court case and should be argued in court and not in the press," DeBord said. He also pointed out public statements might prejudice potential jurors.
Another of Peterson's attorneys, Andrew Abood, wrapped himself in the First Amendment and stressed the need of a free press.
"I think it's important that the press has a role in these public proceedings," Abood said.
Schoenstedt apparently agreed, as he denied the motion.
The judge must have some concerns about finding an impartial jury, however, as he said he planned to call nearly triple the pool of the 35 potential jurors he usually summons. Peterson's attorneys also submitted a draft of a juror questionnaire and prosecutors are to draw up their own.
Peterson's son
Brodsky also tried to have Schoenstedt eliminate Peterson's son, Stephen Peterson, as a potential witness in the gun case. Stephen Peterson is named in the criminal indictment against his father for allegedly possessing the weapon as well, but has not been charged.
"Stephen Peterson has been named in the indictment as an unindicted co-conspirator, I guess, for lack of a better word," Brodsky said.
Brodsky and Abood said Stephen Peterson would invoke his right not to incriminate himself and refuse to testify if prosecutors called him as a witness. DeBord countered that the state could grant Stephen Peterson immunity to compel him to testify. Schoenstedt declined to eliminate Stephen Peterson as a witness for the time being.
Brodsky said his client's son would not pose a problem to Peterson's defense.
"I'm not worried about anything Stephen Peterson is going to say," he said. "It doesn't concern me at all."

A Will County judge on Thursday said he is in possession of an "extensive" number of CDs, DVDs and tapes related to the surveillance of former Bolingbrook police Sgt. Drew Peterson, the suspect in the disappearance of his fourth wife.
Judge Richard Schoenstedt made the disclosure at a pretrial hearing where Peterson's legal team sought to gain information regarding any electronic surveillance that police may have conducted on him.
Peterson, 54, was in court facing felony gun charges for allegedly possessing a modified assault rifle with a barrel of less than 16 inches in violation of state law. Authorities seized the rifle after search warrants were executed as part of the investigation into the Oct. 28 disappearance of Peterson's fourth wife, Stacy. She was 23 at the time she vanished.
Authorities are also re-examining the death of Peterson's third wife, Kathleen Savio, who, at 40, was found dead in an empty bathtub in her Bolingbrook home in 2004.
Peterson has not been charged in either case and maintains his innocence.
On Thursday, Schoenstedt's remarks confirmed for the first time that authorities have secretly recorded Peterson as part of their investigation.

But what type of surveillance authorities carried out was not discussed in open court. The information is under seal, and Schoenstedt did not elaborate beyond saying the amount was extensive. Afterward, Peterson's attorneys declined to comment further.
"I really can't get into the details of what's printed in that list. But I would say that, if I'm police and I'm investigating a gun case like this, electronic surveillance is not going to play a big part in my investigation," Peterson's attorney Joel Brodsky said.
In July, Peterson's former friends, Len Wawczak and Paula Stark, went public with claims that they wore a wire and recorded conversations with Peterson about both cases regarding his wives. Law-enforcement officials had never confirmed their statements.
In court, Brodsky and his fellow attorney, Andrew Abood, also argued a series of motions related to the gun charges. The Will County state's attorney's office had requested a gag order, which Peterson's attorneys successfully blocked. They also won the right to interview Bolingbrook police about whether Peterson used the rifle as a secondary duty weapon, which he claims.
But they were unsuccessful in their motion to bar the department's rules and regulations from trial, although Schoenstedt said rulings on motions could be revisited. Another motion to be discussed at a later date is whether testimony from Peterson's son, Stephen, will be excluded at trial. Peterson allegedly transferred the gun to his son, an Oak Brook police officer, according to the indictment.
The next court hearing is scheduled for Oct. 23 to discuss jury selection. Peterson's attorneys are considering requesting a change of venue, believing he may not get a fair trial in Will County.
The trial is scheduled to begin Dec. 8.

Investigators have amassed an "extensive" collection of secretly recorded conversations involving Peterson, a Will County judge disclosed at a hearing Thursday.
It's the first independent verification that police investigating Peterson used electronic surveillance in an effort to collect evidence against the former Bolingbrook cop.
In July, Len Wawczak and Paula Stark, former friends of Peterson, claimed they had secretly taped months of conversations with him for investigators probing the October 2007 disappearance of his fourth wife, Stacy, and the 2004 drowning death of his third wife, Kathleen Savio. Authorities haven't confirmed their claims, but on Thursday, Judge Richard Schoenstedt said investigators used court-approved electronic eavesdropping to compile tapes, CDs and DVDs focusing on Peterson.

The information was disclosed when attorneys defending Peterson on a felony weapons charge asked for access to any police eavesdropping that could be related to that case. Peterson was hit with the gun charge after a November search of his home turned up what authorities allege was an illegally modified assault rifle.
Schoenstedt deferred a ruling on whether defense attorneys can review any recordings before Peterson's upcoming weapons trial.
After the hearing, defense attorney Joel Brodsky downplayed the significance of any recordings, saying Peterson isn't concerned.
"He's not afraid of anything he said," Brodsky said after the hearing. "We have no fear of anything that could be contained in those tapes."
Peterson attended the hearing but left without commenting.
Schoenstedt deferred a ruling on whether Peterson's adult son, Steve, will be called to testify when Peterson stands trial on the weapons charge.
Given the extensive publicity, Schoenstedt said he plans to elect a jury from a pool of about 100 potential jurors -- three times the amount he typically calls in for a felony trial.

Peterson: New Book Misses The Positive Drew

Peterson says the book is too negative.
He says the author should have focused more on the positive: He says he passed a polygraph test related to the death of his third wife Kathleen Savio. And mostly passed a polygraph test on Stacy's disappearance - with three answers called "deceptive," and Peterson says he can't explain why.
"Number one, I didn't hurt these women. I didn't cause any death to these women. I didn't have nothing to do with removing them from my home. I had nothing to do with, really, either of these incidents."

New book concludes Peterson deceptive, but not a killer
The new book "Drew Peterson Exposed" about the former Bolingbrook police officer and his dead third wife and missing fourth wife is billed as a 300-page news story. And it does have some news.
Peterson - under a cloud of suspicion after his third wife Kathleen Savio's mysterious death was finally ruled a homicide and his fourth wife Stacy Peterson vanished nearly a year ago - agreed to take separate polygraph tests to address questions about both cases.
Lee McCord - described by author Derek Armstrong as an expert polygrapher with 30 years experience - administered the tests and concluded Peterson was truthful when he said he had nothing to do with the death of Savio.
But in a polygraph focusing on the disappearance of Stacy Peterson, McCord found Peterson "deceptive" in answering three of six questions. The polygrapher asked: "Do you know the whereabouts of your wife Stacy?" Peterson said "no" - a response the tester deemed "deceptive." Peterson said "yes" to whether he got a call from his wife the night of her disappearance. Again, McCord said that was "deceptive," and concluded the same to Peterson's "yes" to whether he last saw his wife at their home before going to bed after an overnight shift at work.
Author Armstrong, who bills himself as a journalist, author of mystery thrillers and "marketing guru," examines the results of the polygraph and concludes that Peterson, who has never been charged with a crime in connection with his wives but has been described by authorities as a "suspect" in Stacy Peterson's disappearance, would not have harmed his wives.
Peterson says he hasn't read the book, but he thinks other people should read it.
In an interview, Peterson said the polygraph results prove what he's been saying since Stacy Peterson vanished last Oct. 28 - that he had nothing to do with her disappearance or with Savio's death.
"I've been telling the truth all along," Peterson said. "Why would I take (the lie-detector tests) if I was gonna lie?"
Peterson cooperated with Armstrong, sitting for extensive interviews with the Canadian writer to provide what he called an "objective" account of Savio's death and Stacy Peterson's disappearance.

"I said, 'Let's get this story out there from an objective point of view,'" said Peterson, who said he has no financial stake in the book.
Citing the reliability of polygraph tests, Armstrong concluded: "There is between an 86 percent and 98 percent likelihood Drew Peterson is not guilty."
Still, Armstrong wrote, Peterson provided seemingly "deceptive" answers to three questions, including one in which he denied knowing where Stacy is.
Peterson said he answered all the questions truthfully - and is surprised several answers were deemed questionable.
"I can't even speculate on it. I don't know why," Peterson said of the polygraph results, before speculating about one answer the author deemed deceptive.
"I have my suspicions where Stacy is. Maybe that has something to do with it," said Peterson, who has said he believes she left him voluntarily, possibly for another man.
The new book doesn't sit well with relatives of Savio or Stacy Peterson, who note the polygraph tests aren't admissible in court.
"It's meaningless," said Pam Bosco, a spokeswoman for Stacy Peterson's family. "We're not changing our view of what his involvement was with Stacy and Kathleen."
Armstrong apparently views the 54-year-old Peterson differently, at one point calling him "a good father, a moral enigma, but not a killer."
To which Peterson said: "Thank you, I'll take that description."

In his new book, Drew Peterson Exposed, author Derek Armstrong writes at one point about two separate polygraph tests that the former Bolingbrook cop agreed to take amid questions about the death of his third wife, Kathleen Savio, and the disappearance of his fourth wife, Stacy Peterson. "To the question 'On Sunday October 28, 2007, did you last see your wife Stacy in your home before going to bed after coming home from work?' you answered Yes. This is a deceptive answer."
He waits for a reaction. He sees none.
"To the question 'Did you have any involvement in the physical removal of your wife Stacy from your home on Sunday October 28, 2007?' you answered No. There is no deception."
Still no reaction.
"To the question 'Did you in any way physically harm your wife Stacy during the time she disappeared?' you answered No. There is no deception."
Peterson stares at the chart.
"To the question 'Do you know the whereabouts of your wife Stacy?' you answered No. This was a deceptive answer."
"To the question 'Did you receive a phone call from your wife Stacy on the evening of October 28th, 2007, telling you that she was leaving you?' You answered Yes. This was a deceptive answer."
"To the question 'Did your wife Stacy call you on Sunday, October 28th, 2007, and tell you that if you wanted the car it was parked at the Clow Airport?' you answered Yes. There was no deception."
Peterson nods. "Thank you."
In another excerpt, the author examines the results of the polygraph tests:
On the key questions of whether he harmed either wife, the answers seems to be conclusively no, he did not harm them. Assuming we accept the researched statistics on polygraph reliability, there is between an 86 percent and 98 percent likelihood Drew Peterson is not guilty.
His ordeal of "trial by media" was perhaps unnecessary.
Of course two questions remain. He may not have harmed either wife, but why is he being deceptive regarding the less important questions regarding seeing Stacy after he went to bed the morning of Oct. 28, 2007 and whether she called to tell him she was leaving? My theory is a personal one. There is some ego involved here. He has given his timeline and explanations of events as he remembers them. The polygraph might point to errors or deliberate oversights on two key points, but his pride or ego won't allow him to clarify.
I propose this theory after having spent a lot of time with this enigmatic man. He strikes me as a misunderstood man, a good father, a moral enigma, but not a killer. Is he a liar? Perhaps in areas that might affect the opinion of his children.
In Peterson's world, his children are everything.
Did Peterson distort the truth on these two key points of seeing Stacy and her calling to say she was leaving him because this truthful answer would be less appetizing to his children? I think this might be the case, but it's only my opinion. A plausible one, but not definitive.

As Joseph Hosey relates in Fatal Vows: The Tragic Wives of Sergeant Drew Peterson a twist in the story revived it. Long suspicious of Drew Peterson, authorities decided to re-open the investigation into the death of his third wife, Kathleen Savio. In February of this year, a second autopsy was held on her body with the new finding that her death was ruled a homicide. It seemed that half of Drew Peterson's wives had ended up either dead or missing.

DREW'S TIMELINE
In the new book "Drew Peterson Exposed," the former Bolingbrook cop for the first time provides his own detailed account of his actions Oct. 28 -- the day his fourth wife, Stacy Peterson, disappeared:
5:30-6 a.m.: Came home from Bolingbrook Police Department, talked to Stacy, who said she was going to visit her grandfather, and went to sleep.
10-10:30 a.m. (or 11 a.m.): Awakened by children, Stacy gone and kids home.
Noon-1 p.m.: At home with kids.
1-1 :30 p.m.: Children at home (Tom and Kris watch Anthony and Lacy), runs errands.
2 p.m.: Calls Bolingbrook police to take the night off. (He was retiring in December and had sick time to use or lose.)
3: 15 p.m: Tom, his 14-year-old son, is picked up by friends for a band concert.
6 p.m.: Takes Kris, Anthony and Lacy to McDonald's. They have dinner and play at the playground at McDonald's.
7 :30 p.m.: Returns home with Kris, Anthony and Lacy.
8 p.m.: Tom gets home from band concert.
9 p.m.: At home, receives call from Stacy that she found someone and is leaving.
9: 15 p.m.: Leaves home to go and look for Stacy.
11-11: 30 p.m.: Returns home and gets call from Stacy's sister, Cassandra Cales while still in the driveway. Tells her Stacy called and said she left with another man and took her passport, money and clothes.
11: 45 p.m.: Walks and gets Stacy's car and drives it home.
Midnight: Gets home and goes to bed.
Around 2:30 a.m.: Gets call from Bolingbrook police telling him Cassandra Cales is filing a missing-persons report regarding Stacy. Vaguely recalls getting another call, maybe from Cassandra's friend Bruce Zidrach. (Very tired and does not have a clear recollection of call).

Peterson's stepbrother is back home
BOLINGBROOK -- A potential key piece to the Stacy Peterson puzzle is back in the neighborhood.
Tom Morphey, the stepbrother of Drew Peterson and the man believed to have helped the serial marrier carry a suspiciously warm barrel out of his house hours after his fourth wife was last seen alive, is home again in Bolingbrook.
Peterson even claims to have recently bumped into his stepbrother in a local Meijer store, and says his stepbrother was so scared he went "poof" and disappeared.
Morphey's girlfriend, Sheryl Alcox, disputes this account. She said she was with Morphey when they saw Peterson and, while Peterson has never been shy when he has seen her solo, he steered clear when he spotted her in the company of her live-in boyfriend.
"He didn't come near us that time," Alcox said, adding, "Every single time he's walked up to me in that store when I was by myself."
Morphey's tie-in
State police named Drew Peterson a suspect in the "potential homicide" of his fourth wife, Stacy, who vanished just over a year ago.
Shortly after she disappeared, reports claimed Morphey helped Peterson carry a warm, blue barrel from Peterson's bedroom to the driveway and his waiting Yukon Denali.
Upon learning Stacy had been reported missing, Morphey was hospitalized after overdosing on sleeping pills. Peterson visited him in Naperville's Edward Hospital.
Morphey then became scarce.
Alcox, at the time, said he was in "therapy." Other sources said he was in police protective custody. Peterson has repeatedly said the authorities had put Morphey someplace to "dry out."
If Morphey is an important element in unraveling the mystery of what happened to Stacy, he has yet to tell his story to the special grand jury empaneled for that very purpose nearly a year ago, Alcox said.
Back home
State police spokesman Lt. Luis Gutierrez declined to comment on Morphey's role in the investigation or whether he had been in police custody.
"We're not going to give that information out," Gutierrez said. "We can't comment on that issue."
Regardless of where he has been, Morphey is back now in his Thistle Drive home. Alcox would not say where Morphey was when he was gone, or why he wasn't, but said the separation from her boyfriend was difficult.
And Morphey was not the only one displaced after Stacy disappeared.
"Me and my kids had to be gone for a while," Alcox said.
'She was fantastic'
Alcox said she met Stacy Peterson soon after taking up with Morphey in 2000.
"Stacy, yeah, she was wonderful, she was fantastic," Alcox said as she insisted the young mother would never abandon her children to run off with another man, as Drew Peterson has accused her of doing.
Even though her boyfriend has returned home, Alcox has said her life has not returned to normal.
She does not know if it ever will, unless Peterson is charged with Stacy's murder, she said.
"I pray to God he will be," she said. "I'll be in court every day."

Peterson questions gun case timing
Authorities used "vindictive and selective" prosecution in their gun case against former Bolingbrook Police Sgt. Drew Peterson, his legal team argued in Will County Court today.
Peterson, 54, faces felony gun charges for allegedly possessing a modified assault rifle with a barrel of less than 16 inches in violation of state law. Authorities seized the rifle, along with other weapons, after search warrants were executed last November as part of the investigation into the Oct. 28, 2007 disappearance of Peterson's fourth wife, Stacy.
But Peterson's attorney, Joel Brodsky, questioned the timeline of how the gun case unfolded. In February, police revoked Peterson's firearm owner identification card after a judge ruled that his firearms should be returned to Peterson granted that he had a valid FOID card.
And then in May, authorities arrested Peterson for owning the rifle on the eve of learning from the judge whether the guns could be turned over to his son, Stephen, an Oak Brook police officer.
Brodsky is requesting that prosecutors turn over documents leading up to the charges against his client.
"This timeline proves with more than sufficient evidence that the reason to do this is to punish Mr. Drew Peterson for exercising his Constitutional rights," Brodsky said.
Peterson, who maintains his wife ran off, has said that he used the rifle as a SWAT team member for the Bolingbrook police department.
Will County Assistant State's Atty. Dede Osterberger argued against giving the defense "privileged information."
"We strongly argue against this case, judge, because we think that the defense is engaging in a fishing expedition," she said.
Judge Richard Schoenstedt, who was battling a cold and losing his voice, said he would defer his ruling until the next scheduled hearing on Nov. 20.

Lawyers say Peterson felony charge 'unfair'
The cops are picking on Drew Peterson, his lawyers say, and are so intent on meting out punishment that they unfairly pinned a felony on him.
Peterson's attorneys argued on Wednesday that the state should fork over internal documents outlining how they decided to bring a felony gun charge against Peterson in May.
To prove the vindictive and selective prosecution of Peterson, one of his two defense lawyers, Joel Brodsky, laid out a timeline of events beginning with the state police seizing firearms from Peterson's house four days after his young wife, Stacy, vanished and culminating with Peterson's May arrest.
Brodsky's timeline showed that at one point during the ongoing court battle Peterson waged to reclaim his guns, Judge Richard Schoenstedt ordered they be returned. But the very next day, the state police revoked Peterson's firearm owner's identification card, effectively blocking the judge's order.
The gun charge stems from Peterson possessing an assault rifle with a barrel allegedly shorter than the state-mandated 16 inches. Peterson maintains he carried the weapon as part of his duties with the Bolingbrook Police Department's SWAT team and with the knowledge and permission of his superiors.
Peterson's other attorney, Andrew Abood, claimed a statement made by the spokesman for the state's attorney's office showed the vindictive nature of the case.
Following Peterson's arrest -- which occurred the day before Schoenstedt allowed Peterson's son, Stephen Peterson, to take possession of eight of his father's confiscated firearms -- Pelkie said, "An illegal weapon might be put back on the street and we can't let that happen."
"Because Mr. Peterson asserted his constitutional right, we decided to charge (the gun case)," Abood said in his interpretation of Pelkie's statement.
Brodsky and Abood also said the case was selective because the indictment against Peterson accuses his son Stephen of possessing the assault rifle but does not charge him with anything.
If Peterson's defense team succeeds in convincing Schoenstedt to order the release of the documents, a jury would have to acquit Peterson if they decide the prosecution was vindictive or selective.
Besides the gun charge they brought against Peterson, state police have named him a suspect in the October disappearance of fourth wife Stacy Peterson. The state police also are investigating the March 2004 homicide of Peterson's third wife, Kathleen Savio. At the time of her death, the state police found no indication of foul play but got another crack at it after Stacy disappeared.
Assistant State's Attorney Dede Osterberger called Brodsky and Abood's case a "fishing expedition."

"I'll confirm that Drew Peterson did have a consultation with Jeff Leving," said Joel Brodsky, Peterson's criminal defense attorney.
Peterson, 54, is a suspect in his wife's disappearance, which police have labeled a "potential homicide." Authorities are also re-investigating the 2004 death of his third wife, Kathleen Savio.
In Illinois, willful desertion or abandonment for at least one year is grounds for a divorce. Brodsky said Peterson met with Leving after the year anniversary of her disappearance. Derek Armstrong, author of "Drew Peterson Exposed," reported the meeting Monday.
"I can confirm that he was in my office," Leving said, but declined to comment further. Leving said he met with Peterson on Nov. 11.
