SJ: UPDATE: 12-YEAR-OLD GIRL FOUGHT FOR HER LIFE DURING ABDUCTION
cbs5.com - 10/09/07
SAN JOSE (BCN) -- A man driving a white sedan Monday afternoon deliberately struck a 12-year-old girl before abducting her and attempting to molest her, San Jose police announced today at an afternoon news conference.
The brazen daytime attack began at 4:17 p.m. near Gardendale Drive and Barbara Way in San Jose's Almaden Valley neighborhood, when the man waived for the girl and her 9-year-old sister to cross the street before plowing into her and driving away. The man then drove to the next block before making a U-turn and returning as the girl's 9-year-old sister tried to help the victim to the sidewalk.
Excerpt: The man punched the girl several times during the attack, Muyo said.
"This is a 12-year-old girl who is severely injured fighting for her life,'' Muyo said about the attack.
During the attack, the girl was able to free herself and run to a nearby house. She remains in a local hospital and could stay for several days due to "severe injuries." .....

mercurynews.com - By Sandra Gonzales - 10/09/2007 01:34:27 AM PDT
San Jose police Monday night were searching for a man they say kidnapped a 12-year-old girl in broad daylight and possibly sexually assaulted her during the 20 minutes she was missing.
About 4:15 p.m. Monday, the victim and her younger sister were returning home from a store in Almaden Valley when a man pulled her inside a white car on Gardendale Drive at Barbara Way, said San Jose police Sgt. Nick Muyo.
The victim's sister told her mother what had happened, and police were called to the area near the Walgreens store at Almaden Road and Koch Lane.
Twenty minutes later, Muyo said, the child either escaped or was dropped off in the 5900 block of Sterling Oaks Drive, about 3 1/2 miles south of the store. .....

When the doorbell rang at Jeff Gans' house late Monday afternoon, the 21-year-old didn't know he was about to play a role near the end of a terrifying kidnapping.
On his doorstep stood a 12-year-old girl with a blond bob and blood running from her arm and feet.
"I need help," the De Anza College psychology student recalled the girl saying numbly as if she were in shock. "A car hit me and someone tried to molest me."
Gans had just come home from class and flipped on "Rocky III," but now he was escorting a young, barefoot stranger to his family's dining room table.
"I had her come inside. I gave her a rag, she was pretty bloody, and a glass of water," he said. Gans didn't ask the girl her name. He didn't want to ask her any questions.
"I wanted to make her feel safe. She had been in the world's worst possible scenario," he said. Instead, after she asked to call her mother, Gans handed the girl the phone.
An ambulance and six police cars filled his small cul-de-sac in Almaden Valley in minutes. .....

Man Kidnaps, Possibly Sexually Assaults 12-Year-Old
http://i23.tinypic.com/153tf5z.gif » SJ Police Searching For Suspect
SAN JOSE, Calif. Oct. 9, 2007 (KGO) - A manhunt is underway in San Jose for a man who kidnapped and may have sexually assaulted a 12-year-old girl.
Police in the South Bay are looking for a man they say kidnapped a 12-year-old girl.
San Jose Police are trying to catch this man, they say hit a 12-year-old girl with his car, kidnapped her, in front of her little sister and beat her, while trying to rape her.
Police say the 12-year-old remains in the hospital, recovering both physically and emotionally from the attack.
The kidnapping took place on Monday afternoon just after 4:00 p.m. in the area of Gardendale Drive and Barbara Way.
The 12-year-old was crossing the street with her sister, when a man deliberately struck the 12-year-old with his car. The child landed on the hood and fell to the ground.
The suspect picked up the girl, and then drove about three and half miles away. He stopped near the 5900 block of Streling Oaks Drive, where he beat the girl and tried to sexually assault her.
She fought back and was able to get away, she ran to a near by home.
Police want to put the entire community on alert, and they hope someone in the community will recognize this person, and give police the information they need to solve this crime.
"Remember that this is an assault at 4:15 p.m. on a Monday afternoon in broad daylight. This guy snatches a 12-year-old girl off of a city street in San Jose; very brazen, very bold attack. He is not in custody and there is nothing that suggests he won't try this again until we are able to get him into custody," said a spokesperson from the San Jose Police Department. .....

San Jose girl, 12, fought off assault
mercurynews.com - By Lisa Fernandez, Leslie Griffy and Sandra Gonzales - 10/10/2007 01:30:18 AM PDT
They were walking home when a man in a large white car motioned for the young sisters to cross the street in a quiet San Jose neighborhood just off Almaden Expressway.
The 9-year-old crossed first. Her 12-year-old sister went next. Suddenly, police said, the driver gunned the engine and drove into the older girl, catapulting her onto the hood before she tumbled into the street.
Her younger sister helped her to the curb as the car sped away. But the terrifying ordeal wasn't over. The big white car turned around and came back, the girls told police. The driver forced the older girl into his car, drove off and then later tried to sexually assault her in what police describe as the city's most brazen kidnapping in recent memory.
Tuesday, the severely injured 12-year-old victim remained in the hospital and San Jose police released more chilling details as they urgently asked for the public's help to find the attacker they say is ruthless enough to run down and abduct a child in broad daylight in front of witnesses.
"There is nothing to suggest that he won't try this again," San Jose Police Sgt. Nick Muyo said. "We need help on this one." .....

This man needs to be hunted down like the animal that he is. I can't imagine anyone waving for someone to cross a street and then intentionally driving into that person.
It seems to me that this horrible man wanted an already wounded victim to molest. I pray they find him soon. I can't even find enough of the right words to express how angry and sickened I am that he did this to this young girl.

Abduction unnerves Willow Glen parents
mercurynews.com - By Lisa Fernandez - 10/11/2007
Parents in the typically tranquil San Jose neighborhood of Willow Glen on Wednesday grappled with if and how to tell their children about this week's brazen kidnapping - and lucky escape - of a 12-year-old girl.
Police are still hunting for the suspect - described as being either white or Latino, 30 to 40 years old, about six feet tall with long black hair and a goatee - who allegedly rammed his white sedan into the girl on Monday afternoon.
Police said the man then drove about four miles south and tried to molest her but she got away.
The 12-year-old remained in the hospital on Wednesday, recovering from injuries she suffered from being hit by the car.
She and her 9-year-old sister had been walking home about 4:15 p.m. Monday from the Walgreen's at Koch Lane and Gardendale Drive. The man motioned them to cross the street in front of him before gunning the engine and striking the older girl, San Jose police said. He scooped her up and put her into the car. About 20 minutes later, the 12-year-old punched the man while being assaulted and managed to escape.
Police have not identified the girl because she is a minor, and say there is no known relationship between her and the kidnapper.
Parent Cami Evans lives less than a block away from the kidnapping site. She hadn't planned on telling her 5-year-old son what happened, until she came home Tuesday to discover news trucks on her street. So she used these words to tell him what happened:
"A bad man kidnapped" a girl and drove away, she recalls telling her kindergartner, who attends nearby Schallenberger Elementary School. "You need to be careful. Never go to someone's car that you don't know." .....

09:32 PDT SAN JOSE -- A man who allegedly kidnapped and tried to sexually assault a 12-year-old San Jose girl after he deliberately struck her with his car has been arrested, police said today.
Officers arrested Donald C. Bachmann, 27, of San Jose, late Wednesday, San Jose police Sgt. Nick Muyo said. He would not release more information on where Bachmann was arrested.

Suspect in San Jose kidnapping has series of drug convictions
Mercury News - By Sean Webby, Lisa Fernandez and Brandon Bailey - 10/12/2007
Within hours of the crime, a dragnet closed on Donald Charles Bachmann, a long-time drug user with a history of minor offenses. San Jose street cops, investigators and an alert dispatcher moved quickly to connect scattered events in the tense hours after a man smashed a stolen Toyota into a 12-year-old girl and then, police say, tried to molest her. .....
Excerpt: Late Thursday night his parents issued a statement disputing authorities' contention that he had tried to rape or molest the girl.
Lance Bachmann, 57, told the Mercury News that his son was high on drugs when he struck the girl with the car but he hadn't meant to harm her. The father said his son was trying to take the girl to the hospital.
"His attempt to help was misinterpreted as an attempt to kidnap the girl," he said.
Court records show Donald Bachmann is a longtime methamphetamine user with numerous convictions for possessing drugs or being under the influence of drugs. He has drifted from one low-paying job to another, and last year gave up custody of his one-year-old son to his own parents, after they told a court that Bachmann and his girlfriend could not properly care for the child.

S.J. Man Accused Of Kidnapping Girl Appears In Court - Not The First Time He Faces A Judge

SAN JOSE, Calif. Oct. 12, 2007 (KGO) - We have our first look at the 27-year-old man accused of running down a 12-year-old girl in San Jose, kidnapping and molesting her. The suspect has been in and out of the justice system and a conviction could mean a life sentence.
Donald Bachmann tried to hide his face from television cameras during his brief court appearance.
The District Attorney's Office has upgraded the charges against Bachmann to include molesting a 12-year-old girl on Monday after investigators say he intentionally hit his victim with a stolen car and kidnapped her.
According to a police timeline, she was in the car for a total of 18 minutes.
"A child molestation can occur in a very short period of time, it could be a matter of seconds. If the perpetrator intends to touch a child for the purpose of sexual gratification, they touch the children, it's a crime," said Deputy District Attorney Ray Mendoza. .....

License plate recognition tools led to abduction arrest
sfgate.com - Demian Bulwa, Chronicle Staff Writer - Saturday, October 13, 2007
The swift arrest of a San Jose man in the abduction of a 12-year-old girl this week was aided by an eye-opening gadget that can scan the license plates of a street full of cars and instantly alert police to which vehicles have been reported stolen.
It was a breakthrough moment for license plate recognition, a technology that is spreading to law enforcement around the Bay Area - and is prompting privacy concerns.
San Jose police Officer Max Boyer was on routine patrol Monday, hours after the girl had been rammed with a stolen car and pulled inside while she was walking with her sister in the Willow Glen neighborhood. Police said her attacker had tried to sexually assault her before she fought back and escaped barefoot.
As Boyer passed by parked cars, one of four cameras mounted on his cruiser seized on a plate, compared its characters to a database of stolen cars and triggered an alarm.
"Stolen car," a computer voice said. Boyer pulled up next to a white Toyota sedan, which investigators soon concluded was the one that had struck the girl. .....

Girl details abduction by "creepy'' man who had been staring at her
Mercury News - By Brandon Bailey - Article Launched: 10/13/2007 01:48:11 AM PDT
A "creepy" man was staring at her, the 12-year-old girl would later tell police, as she walked into the Walgreen's with her little sister on an errand for their mom.
Minutes after they left the store, the girl said, she saw the same man bearing down on her from behind the wheel of a white sedan.
The terrified girl's account was detailed in police reports filed in court on Friday, as authorities formally charged 27-year-old Donald Bachmann with kidnapping for the purposes of a lewd act on a child, forcibly committing a lewd act on a child, assault with a deadly weapon and other offenses that could land him in prison, if convicted, for 34 years to life.
In two interviews with police, the girl described how the white sedan struck her hard enough on Monday afternoon to make her black out. She said she regained consciousness in the car's back seat. The man drove for a while, she said, before he stopped and tried to pull off her clothes. She managed to escape, but that wasn't the end of her ordeal.
Stunned and frightened, the girl said she ran to a nearby house but no one was home. At a second house, a woman refused to let her borrow the phone. Finally, the girl said she knocked on a third door where a young man let her inside, gave her a drink and assisted her in phoning for help. .....

Perhaps the perp should have chosen option A as listed by his dear ol' dad--wait at the accident scene for an ambulance and ---oh, that would be a problem--the police!!! Guess that would be why he didn't choose option "A"!!!
Hit and run-doesn't sound like he would be too worried about that.
So, we get to option "C"---take the girl to a hospital. I don't know where the nearest emergency room or trauma center are, wonder if where the girl showed up was between the nearest ED and the accident site, or in another direction?
And, was he under the influence at the time of the incident? If he was, I don't suppose logical tho'ts of action were going thru his mind at all--except the part where he certainly would not want to wait for assistance, as that would include LE. IMO
The woman in the second house should have called 911 if the girl appeared at her house in the same condition she appeared at the third house. Even if she didn't want to let the girl in to use her phone, she could have called herself. IMO

Kidnap suspect quickly in officers' sights

Within hours of the crime, a dragnet closed on Donald Charles Bachmann, a longtime drug user with a history of minor offenses.
San Jose street cops, investigators and an alert dispatcher moved quickly to connect scattered events in the hours after a man smashed a stolen Toyota into a 12-year-old girl. .....
Excerpt: Assistant Police Chief Tuck Younis credited the quick arrest to a coordinated effort by the police department and the district attorney's office.
"But let us not forget," Younis added, "that there is a 12-year-old little girl who still lies at a local hospital with significant injuries she is recovering from."
On Monday, police say Bachmann drove a stolen pickup into a 7-Eleven parking lot in West San Jose and asked for help with a jump-start.
But instead of leaving in the pickup, he sped away in an employee's car. It was that car he used in the attack, police say.
The young kidnap victim and her 9-year-old sister were walking home from a Walgreen's Drug store in Willow Glen, when a motorist gunned his engine and drove into the 12-year-old.
The impact catapulted the older girl onto the car's hood and dropped her onto the street. Police said Bachmann forced the 12-year-old into the car, drove off and later tried to sexually assault her.
She escaped from the car after punching her assailant, and then she ran barefoot to a nearby home, where a man gave her a phone to call for help.
