Judge denies bid to expand jury pool for Cutts murder case

CANTON Attorneys for Bobby L. Cutts Jr. set out to protect his right to a fair trial, starting with who might be on a jury that hears the case.

Jury selection was one of several issues discussed Friday by defense attorneys, county prosecutors and the judge during a hearing at the Stark County Jail.

Stark County Common Pleas Judge Charles E. Brown Jr. denied most of the 20-some defense motions, which is not uncommon.

Cutts, 30, has pleaded not guilty to three counts of aggravated murder and other charges tied to the deaths of Jessie M. Davis, 26, of Lake Township, and her unborn daughter. If convicted, he faces a potential death sentence.

CANTON Attorneys for Bobby L. Cutts Jr. set out to protect his right to a fair trial, starting with who might be on a jury that hears the case.

Jury selection was one of several issues discussed Friday by defense attorneys, county prosecutors and the judge during a hearing at the Stark County Jail.

Stark County Common Pleas Judge Charles E. Brown Jr. denied most of the 20-some defense motions, which is not uncommon.

Cutts, 30, has pleaded not guilty to three counts of aggravated murder and other charges tied to the deaths of Jessie M. Davis, 26, of Lake Township, and her unborn daughter. If convicted, he faces a potential death sentence.

Cutts, a Canton police officer, and Davis have a young son, and Davis' family has said he was the father of the unborn child, a girl to be named Chloe.

Defense attorneys wanted to include licensed drivers in the list of potential jurors. They contend it would expand the pool and include more minorities.

Trial To Begin For Suspect In Pregnant Woman's Death

CLEVELAND -- A judge said Friday he'll allow a medical examiner to testify about how a pregnant woman died, despite objections by a defense attorney.

Myisha Ferrell, 30, is accused of helping to dispose of the body of Jessie Davis, 26, whose disappearance in June drew national attention as thousands searched for her. Davis' police officer boyfriend is charged in the deaths of Davis and her unborn daughter.

Jury selection in Ferrell's case begins Thursday in Stark County Common Pleas Court with opening statements expected Nov. 5. Ferrell faces up to six years in prison if convicted of obstructing justice and complicity to gross abuse of a corpse.

A judge on Friday denied a defense motion that claimed the autopsy findings in the death of Jessie Marie Davis should be excluded at a trial because they are ''pure speculation.''

Defense attorney John Alexander contends that the conclusions by Summit County Medical Examiner Lisa Kohler are not based on scientific certainty.

Alexander wants the doctor's testimony barred from the trial of Myisha Ferrell, which starts Nov. 5. Ferrell is accused of obstructing justice and abuse of a corpse.

Stark County Common Pleas Judge Charles E. Brown ruled Kohler may testify.

The defense motion was one of several considered during a hearing that yielded tidbits of the well-guarded police investigation into Davis' disappearance and death last June.

Ferrell, 30, is accused of helping Canton patrolman Bobby Cutts Jr. move Davis' body and then lying to investigators while the pregnant Lake Township woman was missing for nine days last June. — continued: »

CANTON - The Summit County medical examiner can give her opinion on how Jessie M. Davis died, but must turn over the police reports she used to reach that conclusion, a judge said Friday.

With the first phase of Myisha L. Ferrell's trial set for next week, Stark County Common Pleas Judge Charles E. Brown Jr. held a hearing Friday to resolve some matters.

He excused several prospective jurors from service for various reasons, including age, illness and work conflicts.

Ferrell, 30, of Canton, is charged with obstructing justice and complicity to gross abuse of a corpse. She faces up to six years in prison if convicted.

Isn't it funny that a gf from school (isn't that who she is or was to Butts) helped him dispose of the body, but nothing else?? Does anyone else think she could have been part of the murder (meaning helping killing her)?

CANTON - A jury of 12 and two alternates has been seated to hear the case of Myisha L. Ferrell.

Opening statements and testimony in Ferrell’s trial are scheduled to begin Monday morning. Stark County Common Pleas Judge Charles E. Brown Jr. told jurors to expect to begin deliberations sometime on Wednesday.

The jury consists of six men and six women, all of them white. The two alternates are white women. — continued: »

so this woman gets 2 years possible one year for help in dumping a pregnant womans body, is this case even being considered a double murder due to the woman being pregnant?
