View Full Version : Guy charged with murder "incompetent" BEFORE trial even begins...

For those who thought they saw it all, there is a case here in Sarasota,Florida where a woman was killed, and DNA evidence leads
to the arrest of a man, and, not long after the arrest, the court is somehow
persuaded to declare him incompetent, and then they send him to the state
prison system's mental hospital, and, three years later, he is now declared competent to stand trial.

I have never heard of a case, until now, where the defendant is deemed incompetent BEFORE a trial starts, and then, after 3 years, he is now able to go to trial.

It seems to me that, almost all the time, the defense goes the incompetent/temporary insanity/diminished capacity route AFTER the trial starts, and then argues their case during the sentencing phase?
