Cutts disciplinary hearing set
UPDATE: 4:12 PM, Monday, September 10, 2007
REPOSITORY STAFF REPORT
CANTON A predisciplinary hearing for suspended Police Officer Bobby L. Cutts Jr. has been tentatively set for 1 p.m. on Sept. 25 at the Stark County Jail.
Stark County Common Pleas Court Judge Charles E. Brown Jr. must approve the setting of the hearing, because city officials are not on the list of people who are permitted access to Cutts at the jail, said Kris Bates, assistant city law director.
Safety Director Bernard Hunt made the request Friday.
Cutts is accused of killing his son’s mother, Jessie M. Davis, and her unborn daughter. He faces three counts of aggravated murder and other charges and could get the death penalty if convicted.
Cutts was hired by the department in 2000 and is suspended without pay.
The city is accusing Cutts of violating rules involving conformance to laws and failure to report to work, Bates said. The disciplinary charges have been recommended by the internal affairs division of the Police Department.
The Canton Police Patrolmen’s Association union contract allows a hearing to take place, Bates said, but a decision cannot be rendered until the completion of the court case for any charges directly related to the criminal case.
Some of the three disciplinary charges directly stem from the court proceedings, she said.
