View Full Version : Defense "Cutting Short" It's Case ??!!

I'm really interested in what others think. The Defense is curtailing its case, because of what THEY term to be "adverse rulings".
I've watched quite a few live trials. This is the first one, I believe, where the Defense has put on such a poor case. To be completely honest, I might feel this way because of how I feel about this case. I think the Defense set out to "prove" something, when, as we all know, they don't have to do that. They set out to prove Lana Clarkson committed suicide. They have failed miserably. The Defense experts were very obviously "advocates" for the Defense, instead of being unbiased, expert witnesses. I think Alan Jackson was brilliant in his cross-examination of these witnesses.
How many attorneys does Philip Spector have .... 5 ?? Or did I miss one ?? Let's face it .... Bruce Cutler has been totally ineffective. Is he supposed to be giving the closing argument ??
As of today, the Defense has no more witnesses .... they MIGHT have another .... and the Prosecution is proceeding with their rebuttal case.

I believe the Defense knows they've failed miserably. "Blame the victim" defenses rarely, if ever, work. In this case, I believe it was a huge mistake because Lana appears to have been loved by many. The fact she declined PS's invitation numerous times, is proof she didn't carry a gun in her purse, waiting for PS to invite her to his "castle" so she could commit suicide there. To suggest it, along with implying Lana used guns in foreplay, is insulting the jurors' intelligence.
In addition, PS was in possession of several unregistered guns, whose last known owners were scattered in various parts of the country, and whose ownership was more than a decade ago. He told the chauffer "I think I just killed somebody". Women came forward to attest to PS pulling guns on them when they wanted to leave. This jury would have to be deaf, dumb and blind to acquit him.
Alan Jackson has it all: Professionalism, well-informed, intelligent, witty, affable, firm without being overbearing, charming, and he's cute to boot!! He is one of, if not the best, prosecutor I've had the pleasure of watching.

I agree! I've not been able to see all of the defense case ....but imho it is lacking........I think in one of Phil's drunken stupors he pulled out his gun as was his habit...whether it was premeditated I don't really know...but I believe he's a dangerous man....I certainly don't believe Lana chose his home to commit suicide in....! JMHO

We are in agreement on this one, Paula. I was particularly flabbergasted at Dr. Spitz' testimony .... how he did not take Philip Spector's history of violence against women into consideration, when reaching his conclusion. How could one NOT consider that??
I agree with you about Alan Jackson also. He is all of what you mentioned. Is he cute ??? I didn't notice that .... ;) ;)

Good morning, Lady Fisher .... Personally, I think this is where the Defense has made their mistake. They have set out to prove Lana Clarkson committed suicide. I can agree that Spector might not have intended to kill Lana Clarkson .... he might have done what he has done so many times in the past .... got his gun, and the end result MIGHT have been a horrible accident. I firmly believe it was HIS gun.

I think the defense is helping the prosecution by leaps and bounds. First they show the tape, Lana Unleashed, and now this trip to the Castle. Pretty soon, all they will have to do is fill out those jury slips and they finally get to go home, and Spector get's to go to a NEW big house! :D

I think the defense is helping the prosecution by leaps and bounds. First they show the tape, Lana Unleashed, and now this trip to the Castle. Pretty soon, all they will have to do is fill out those jury slips and they finally get to go home, and Spector get's to go to a NEW big house! :D
I cannot understand the defense reasoning behind showing that video, they showed Lana as living human being, something the prosecution wouldn't have been allowed to present.

What I derived, from the airing of that video, was an attempt by the Def to question Lana's integrity. They seemed to harp on Lana making the smoking commercial segments, designed to portray her acting range for the consumption of producers, and which she specified were not to be shown in the USA, to question her credibility and integrity, had her wishes been violated, through no fault of her own because she exercised no physical control over them.
In a nutshell, I viewed it as another venue to attack the victim, which sadly appears to have been the entire strategy of the Def.

I intially thought the purpose was to impeach the witness who said she was a good actress. I thought the tape was supposed to show that she was an awful actress. On the issue of her talent, I've heard mixed reviews on the quality of the acting. Not one said she was great. Many people thought the tape had it's moments of pleasure. Some thougth it showed he wasn't a great actress.
I do think it showed the witness was testifying with a bias to make Lana better than she was, and wish he had been a bit more honest -- but I don't think was anywhere near the level of bias of the defense witnesses.
Also, even it that was it's purpose, I think it missed. She wasn't that awful. Even the Rolling STone reports, which often are softer on the defense than I would be, said showing of the tape was fatal for the defense (usually when they come down on the side of the prosecution for the day's testimony, they just say "bad for hte defense" or "very bad for hte defense")

Sprocket...as I've said, I have not been able to follow this case as closely as I would have liked to....but just reading here...it sounds like the defense has cut it's own throat....why did they go with attacking the victim and screaming it was suicide....everyone knows by Phil's previous actions....it was his gun...and he more than likely pulled the trigger in a drunken stupor....I don't see how he is going to get out of this and imho whether it was intentional on his part or not...he needs to be locked away in a looney bin...jmho

I agree with you, however, the defense has to be to trash Lana- look at what they have to work with. I can't see any other defense and many of these types of defenses have been upheld on appeal- it actually takes a lot to overturn a case. (For example- the defense attorney in one of my client's cases SLEPT during a portion of his drug related trial. The client got 20 years and the appeals court said that it wasn't a big deal that the public defender took a nap!!).

I wonder if they are totally underestimating Alan Jackson ?? They shouldn't. It seems that Alan Jackson has more "smarts" than ALL of the Defense Attorneys put together.
I have a problem with Dr. Baden testifying in the first place .... it just LOOKS odd, since his wife is a member of the Defense Team. He just LOOKS "biased". Now, to come up with this new conclusion, at this late date, as to Lana's spinal cord NOT being fully transected,, is just beyond belief !!!! I really think my jaw dropped to the floor !!
I just can't believe the Defense Attorneys in this case .... ANY of them.

Which tells me once again, there's nothing in writing right? That way, testimony can be given in any which way they want, as in the "NEW THEORY" day before yesterday that caught the Pros off guard and got the defense in trouble. However, I haven't heard what the punishment, if any if going to be.
I had high hopes, that Baden wasn't going to be, like, the likes of Lee and Wecht, but alas, it seems that they are all for hire.
Baden tends to stutter a bit even when on Greta, I think his mind is ahead of his tongue sometimes, seems to happen on the stand too. Anticapting answers to questions, not asked, or not finished... Always wanting to interupt.
But this is clearly a picture of not having control of the courtroom. He is squirming and sighing in that chair quite a bit. The only thing, he hasn't done is gotten nasty like Lee. :)

I just had to pop in and see if it was me or .. is Baden senile?
He has been missing the cues on Greta for sometime now I noticed but .. my goodness gracious .. he needs to retire. I used to like him, he is a mess. Put him with Wecht, Lee and Perper. They should all go to dinner together.
I think his wife being off for his turn is extremely suspect. I don't buy the Michael Jackson bad back excuse myself.
Voting for Baden is going very badly. Did he help the def?
Only 8% yes. .. and Lisa said, ya and that is just LB voting. LOL
Okay, back to ans battle and Spector tv.

I find it extremely odd, Class-Z. Didn't he testify, under cross-examination, that he took NO NOTES !!!??? He had no work product over the period of four years !! I mean .... come on !!
His last epiphany is just suspect .... period !!! The fact he is testifying at all, for the Defense, is supect .
I've noticed him huffing and puffing in that witness chair .... looking extremely uncomfortable.

Question (I don't get to follow this case very much, excuse my ignorance)
Will the jury be told that Baden's wife is on the defense team? I'd think that should be disclosed, IMO it's not ethical.

Oh TD .... In AJ's cross examination, he questioned Dr. Baden extensively about his wife being a member of the Defense Team. AJ certainly intimated there was bias on Dr. Baden's part, because his wife was a Spector advocate. The jury is certainly aware of it.

Isn't it just an absolute miracle, that Dr. Baden finished his testimony last week, and lo and behold, wifey had a miraculous cure and is back at the defense table this morning?

LOL Danni .... I started this thread when the Defense had made the statement they were "cutting short" their Defense case !! I can't even remember when that was now. They seem to be dragging this out now, to unbearable lengths .... I agree with you.
Let's get this to the jury !!!

Hey People,
IMO, the Defense is not cutting anything short. They were done days and witnesses ago and they knew it. Has it clicked to anyone how badly they did NOT want to call Michael Baden with his....for gawd-sake...'AHA' fiasco? They needed something that would put 'close-range' spit, not 'close-range' gun-shot residue on Phil. They figured a 'conflict of interest' charge was a risk-reward chance they would take......Sadly, for the defense, this was only more wild speculation that Lana MOVED after death. I'm a bit surprised they did not have her walking up the stairs, smearing blood on the bannister. I suppose they figured a 'zombie' defense wouldn't fly.
Seems that everyone wants this to go to the jury. My wants are to see the final part of AJ's close. He has been pretty slick to this point. I pray he can continue and convince that ONE juror who can botch a 'guilty' verdict. I can't imagine anyone having a 'reasonable doubt',........but stuff happens. Certainly, Fidler's instructions can FORCE 'reasonable doubt' if worded to imply it.
Hoping for guilty but not holding my breath.

P.S. I was wondering, is 'Freshwater' related to the big-dog on the CTV forum? I've been trying to steer clear of that old Southern family, the 'Water's'. Coldwater doesn't like me much......none.
